Terms of participation “Birthday giveaway”

Hereinafter referred to as “organizer”.
This giveaway is in no way connected to Instagram, Facebook or TikTok and is in no way sponsored, supported or organized by Instagram, Facebook or TikTok.
All questions, comments or complaints about the giveaway should be directed to the organizer at info@inkster.eu.
By participating in the giveaway, participants confirm that they have read, understood and accepted the following conditions of participation:
1. Duration of the giveaway
1.1 The giveaway is open for entries from 12:00 noon on 31.05.2024 until 11:59 pm on 17.06.2024 (the “Participation Period”).
1.2 All entries received after the specified deadline will be excluded from the giveaway.
1.3 The giveaway may be terminated by the organizer at any time without giving reasons. If this is the case, the participants will be informed accordingly.
1.4 The organizer also reserves the right to terminate or change the giveaway at any time without prior notice if, for technical or other reasons, the proper execution of the giveaway cannot be guaranteed or the fairness of the giveaway appears to be impaired. This does not give rise to any claims for the participants.
2. Participation eligibility
2.1 Only natural persons with full legal capacity aged 18 and over who have their permanent residence and habitual abode in member states of the European Union or Switzerland are eligible to participate. Attempts at manipulation will result in exclusion from the giveaway.
2.2 Employees of and relatives of employees of the organizer, service providers who have a direct business relationship with the organizer and its subsidiaries are excluded from participation.
3. How to participate in the giveaway
3.1 You can take part in the prize draw by buying raffle tickets. Tickets can be...
... from 11.06.2024 by placing an order in our online store (www.inkster.eu). Each €10 order value corresponds to one raffle ticket and therefore one (further) chance to win.
...can be won by following our Instagram channel, liking and commenting on the giveaway post (1 raffle)
...be won by following our TikTok channel, liking and commenting on the giveaway post (1 raffle)
...can be won by registering for our pre-sale (1 raffle)
3.2 Personal data such as first name, surname, e-mail address and postal address must be provided in order to participate.
4. Prize
4.1 The main prize is a new “Vespa” scooter, model “Primavera” worth approximately €4000.
The second prize in the giveaway is a trip to Hollywood (USA) for two people worth around €2000.
The third prize is your own custom Inkster tattoo in ten copies and can be won by 5 different people.
4.2 There is no entitlement to additional services.
4.3 There is no entitlement to the prizes. The prizes are not negotiable, exchangeable or transferable. It is not possible to issue credit notes, make cash payments or exchange them for other items.
5. Selection and announcement of the winners
5.1 The winners will be notified via email or a direct message on Instagram or TikTok. The participant is responsible for ensuring that the organizer's messages can be reached.
5.2 The winner has two weeks from the time the notification is sent to accept the prize by replying as a message on the relevant channel. If the winner does not reply within two weeks, the claim to the prize expires and a new winner will be determined and notified.
5.3 The organizer is entitled to exclude participants from the giveaway without prior notice if they do not comply with the conditions on which the giveaway is based or if they manipulate the giveaway, in particular the entry procedure, and/or if they deliberately violate the terms of use.
5.4 The Organizer may exclude participants who revoke the order entitling them to participate from participation.
6. Disclaimer
6.1 Incorrect or incomplete registrations are invalid and do not entitle the participant to take part in the giveaway or to receive the prize. The Organizer is entitled to exclude participants from the giveaway if there is reasonable doubt that participants are using inadmissible methods of participation.
6.2 The Organizer reserves the right to amend these Terms and Conditions of Participation and to terminate or suspend the giveaway at any time if difficulties arise that are likely to affect the integrity of the giveaway and/or its proper conduct. In this case, the Organizer's liability towards the participant is expressly excluded.
6.3 The Organizer is in no way liable for any loss or damage resulting from or in connection with participation in the giveaway or a transmission error or other technical difficulties, unless the loss or damage is due to intent or gross negligence on the part of the Organizer.
6.4 The Organizer shall be released from all obligations upon delivery or handover of the prizes and shall not be liable for any defects in the prizes
6.5 Otherwise, the Organizer shall only be liable for intent and gross negligence. This does not apply in the event of a negligent breach of a material contractual obligation. These are obligations that are essential for the execution of the prize game, as they make it possible in the first place, and on the fulfillment of which the participant therefore relies and may rely. In this case, the Organizer's liability for simple negligence is limited to the foreseeable damage typical for the prize game.
6.6 This exclusion of liability does not apply to damages resulting from injury to life, limb or health.
7. Data Privacy Policy
7.1 The Organizer processes personal data in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). Participants can also view details on data processing in the Organizer's privacy policy.
7.2 The following personal data must be provided in order to participate in the giveaway and/or to receive the prize:
- First name, surname
- e-mail address
- telephone number
- postal address
7.3 By participating in the giveaway, participants consent to the collection and use of their personal data. The organizer collects, stores and processes this personal data in order to carry out and process the giveaway and to notify the participant in the event of a win and to process the handover of the prize.
7.4 The data will not be passed on to third parties. Participants can revoke their consent at any time by sending a message to info@inkster.eu. The personal data will then be deleted. In this case, the participant will be excluded from further participation in the giveaway and any claim to a prize will lapse.
8. Final conditions
8.1 The law of the Federal Republic of Germany shall apply exclusively to the giveaway, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular of the country in which participants as consumers have their habitual residence, remain unaffected.
8.2 Recourse to the courts is excluded. There is no actionable claim to the prize or payment of the cash value.
8.3 Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. An invalid provision shall be replaced by one that is legally possible and comes as close as possible to the content of the invalid provision. The same applies to any loopholes.
